Can we sue the department?

My father was killed in an atv accident at a private residence bussiness. The daughter of the owner was an off duty police officer who was arrested by the responding police officers for being disorderly and interfering with medical personnel as they tried to work on him and get him to the careflight. He died from head injuries the next day. Can we sue the police department she works for as she was presenting herself as a cop to the other officials there. It wasn't her jurisdiction. It happened in ohio.
