Can I file for a lost title of an ATV if the title is not in my name? (Texas)?

I bought an ATV off craigslist and the guy said he had the title. Once I drove 2 hours he "forgot" the title at home. He said he would mail it. Of course, I did not receive it. I had the VIN ran and it is not stolen and is in that guys name. Is there something I can get him to mail to me that gets me the title? Or can I file for a lost title myself to get it into my name?
